1. Acceptance of Terms

Welcome to RecruFlex. These Terms & Conditions (“Terms”) govern your use of the RecruFlex platform, website, mobile applications, and related services (“Platform”) provided by ResourceMojo Business Outsourcing Pvt. Ltd. (“ResourceMojo”, “we”, “our”, “us”).

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

2.Definitions

For the purposes of these Terms:

  • “User” means any individual or entity accessing or using the Platform.
  • “Client” refers to businesses availing recruitment or workforce services via RecruFlex.
  • “Candidate” means job applicants or individuals whose data is processed for hiring.
  • “Team Members” refers to ResourceMojo’s employees, consultants, or recruiters.
  • “Services” means recruitment, staffing, AI-driven matching, talent management, and other HRTech offerings provided via the Platform.

3.Description of Platform and Services

RecruFlex is an AI-powered recruitment and workforce management platform designed to:

  • Enable companies to source, evaluate, and hire vetted talent efficiently.
  • Allow candidates to create profiles, apply to roles, and track progress.
  • Support workforce operations including onboarding, time tracking, and compliance.
  • Provide AI-driven insights and automation to streamline hiring processes.

We reserve the right to modify, enhance, or discontinue any features of the Platform at any time.

4. Eligibility & Account Registration


4.1 Eligibility

  • You must be at least 18 years old and legally competent to enter into a binding contract.
  • If you are registering on behalf of an organization, you must have proper authorization.

4.2 Account Creation

  • Users must provide accurate and complete information.
  • You are responsible for maintaining confidentiality of credentials.
  • RecruFlex may verify provided information and may suspend or terminate accounts for false or incomplete data.

5.User Responsibilities

By using the Platform, you agree to:

  • Comply with applicable laws and regulations.
  • Use the Platform only for lawful and legitimate purposes.
  • Maintain confidentiality of login credentials.
  • Notify us immediately of unauthorized use of your account.
  • Not impersonate any individual or entity, or provide misleading information.

6.Prohibited Activities

Users shall not:

  • Access or use the Platform for unlawful purposes.
  • Reverse engineer, decompile, or tamper with any part of the Platform.
  • Attempt unauthorized access to systems or data.
  • Introduce viruses, worms, or malicious code.
  • Circumvent security measures.
  • Scrape or harvest data without authorization.
  • Use the Platform to discriminate or engage in fraudulent recruitment activity.

7. Intellectual Property Rights

7.1 Ownership

  • All intellectual property, including software, designs, content, AI algorithms, and trademarks, are owned or licensed by ResourceMojo.

7.2 License to Users

  • RecruFlex grants users a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose.
  • This license does not transfer any ownership or intellectual property rights.

7.3 Trademarks

  • “RecruFlex” and related logos are trademarks of ResourceMojo. You may not use them without prior written consent.

8. Data Protection & Privacy

Your use of the Platform is subject to our Privacy Policy. By using the Platform, you acknowledge that we may collect, use, and process data in accordance with applicable laws including GDPR, PIPEDA, CCPA, and Indian IT Rules.

9. Subscription & Payments

9.1 Fees

Certain services may be subject to subscription or usage-based fees. Pricing details will be provided prior to purchase.

9.2 Billing & Taxes

Users agree to pay all applicable charges, including taxes, per the agreed billing cycle. Late payments may attract interest and service suspension.

9.3 No Refund Policy

Unless otherwise specified in a signed agreement, all payments are non-refundable.

10. Third-Party Services & Integrations

The Platform may contain links or integrations to third-party services (e.g., background check providers, LinkedIn, payment gateways).

We are not responsible for third-party content, privacy policies, or practices. Use of third-party services is at your own risk.

11. Disclaimer of Warranties

The Platform and Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

We do not warrant that the Platform will be:

  • Error-free or uninterrupted
  • Compatible with all devices or browsers
  • Free from security vulnerabilities (though we take industry-standard precautions)

12. Limitation of Liability

To the maximum extent permitted by law:

  • ResourceMojo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or reputational damage.
  • Our total liability arising from use of the Platform shall not exceed the total amount paid by you in the preceding 12 months, if any.

13. Indemnification

You agree to indemnify, defend, and hold harmless ResourceMojo, its affiliates, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of:

  • Your use or misuse of the Platform
  • Violation of these Terms
  • Violation of applicable laws or third-party rights

14. Termination

14.1 By User

You may close your account at any time by following the Platform’s procedures.

14.2 By RecruFlex

We may suspend or terminate access to the Platform with or without notice if:

  • You violate these Terms
  • Required by law
  • For maintenance or security reasons

14.3 Effect of Termination

Upon termination:

  • All rights and licenses granted to you end immediately.
  • Certain provisions (IP, liability, indemnification) survive termination.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, with primary jurisdiction in Mangalore, Karnataka.

For users subject to foreign laws:

  • GDPR (EU): Data processing complies with EU regulations; disputes may be subject to EU supervisory authorities
  • PIPEDA (Canada): Users may escalate privacy complaints to the Office of the Privacy Commissioner of Canada.
  • US (CCPA): Users retain rights under applicable state laws.

16. Dispute Resolution & Arbitration

Any disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be referred to binding arbitration in Mangalore, India under the Arbitration and Conciliation Act, 1996.

Arbitration shall be conducted in English, by a sole arbitrator mutually appointed by both parties.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated versions will be posted on the Platform with a revised effective date.

Continued use after changes constitutes acceptance of the new Terms.

19. Entire Agreement & Severability

These Terms, along with the Privacy Policy, constitute the entire agreement between you and ResourceMojo regarding the Platform.

If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.

TEAM DATA POLICY

1. Purpose and Scope

This Team Data Policy establishes how ResourceMojo Business Outsourcing Pvt. Ltd. (“ResourceMojo”, “RecruFlex”, “we”, “our”) collects, uses, stores, shares, and protects data relating to:

  • Employees
  • Consultants
  • Contract recruiters
  • Remote team members

The Policy applies to all internal data collected or processed during the course of employment, engagement, or association with ResourceMojo. It applies globally to all jurisdictions where our teams operate, including India 🇮🇳,the EU 🇪🇺, Canada 🇨🇦, and the US 🇺🇸.

2. Categories of Data Collected

We collect the following categories of data about team members:

2.1 Personal Identification Data

  • Full name, date of birth, gender, contact details, emergency contact
  • Government-issued ID (Aadhaar, PAN, Passport, SSN/SIN for overseas hires)

2.2 Employment & Professional Data

  • Offer letters, employment agreements, role details
  • Payroll, tax records, bank account details
  • Performance appraisals, feedback, promotions, disciplinary records

2.3 Background & Verification Data

  • BGV reports, reference checks, academic certifications
  • Police verification, if applicable

2.4 IT & Access Logs

  • Device identifiers, IP addresses, email system usage
  • ATS (Applicant Tracking System) access history
  • Timesheet entries, leave records, login/logout timestamps

2.5 Special Categories (Where Applicable)

  • Health insurance information (for benefits)
  • Diversity & inclusion data (voluntarily shared)
  • Immigration/visa documents for overseas employees

3.Sources of Data

We collect data from the following sources:

  • Directly from employees during onboarding and through HR systems
  • Automatically from company IT systems (email, ATS, time tracking)
  • Third-party vendors (e.g. BGV agencies, payroll processors)
  • Government authorities for compliance (tax filings, PF, ESIC, etc.)

4. Purpose of Data Collection & Use

We collect and process team data for legitimate HR and operational purposes, including:

5. Access Control and Data Security

We implement Role-Based Access Control (RBAC) to ensure only authorized personnel can access team data.

  • HR staff have controlled access to employment & payroll data.
  • Tech administrators access IT system logs only for operational/security purposes.
  • Background verification data is restricted to compliance & HR.
  • Every access is logged and monitored.

Security measures include:

  • Encryption of stored and transmitted data
  • Two-factor authentication for sensitive systems
  • Regular access audits and revocation for exiting staff
  • Confidentiality agreements for all employees and vendors

6. Cross-Border Data Transfers

As RecruFlex works with distributed teams and global clients, employee data may be transferred to or processed in other jurisdictions (e.g., payroll processing, client project access, remote hiring).

We ensure:

  • Transfers comply with Indian IT Rules, GDPR (using Standard Contractual Clauses), PIPEDA adequacy rules, and CCPA where applicable.
  • Transfers are logged and documented.
  • Employees are informed when their data is processed overseas

7. Data Retention and Deletion

We retain team data only for as long as required by law or legitimate business purposes.

8. Incident & Breach Management

In the event of a data breach involving team information:

  • We will investigate promptly and take containment measures.
  • Affected individuals and relevant authorities (e.g., CERT-In, GDPR DPA, OPC Canada) will be notified as required by law.
  • Post-incident reviews will be conducted to strengthen controls.

9. Third-Party Sharing

We may share team data with:

  • Payroll processors, benefits providers, and government agencies for compliance.
  • IT service providers for infrastructure support.
  • Clients, only in cases of direct deployment or background verification (with prior consent).

All vendors must sign Data Processing Agreements (DPAs) and confidentiality clauses.

10. Policy Enforcement & Disciplinary Action

Violation of this Policy by team members may result in disciplinary action, including but not limited to:

  • Warnings
  • Suspension of system access
  • Termination of employment or contract
  • Legal proceedings in cases of willful breach

11. Policy Review and Updates

This policy will be reviewed annually or as required by law changes. Updates will be communicated to all team members through official channels.
